1.1 "The App" means the Iceland GuideMap mobile application, including its iOS version, future updates, derivative versions and related documentation.
1.2 "The operator" means the developer and operator of the App, Ingolfur Chen, an individual based in Iceland, reachable at ingolfur.chen@gmail.com.
1.3 "User" or "you" means any natural person who downloads, installs, registers for or uses the App.
1.4 "Content" means all information presented in the App, including text descriptions, photographs, images, map data, place (POI) information, F-road tracks, road condition information, fuel price information, exchange-rate information, user interface design, icons and layout.
1.5 "POI" (Point of Interest) means a travel destination marked in the App, including sights, hot springs, waterfalls, hidden gems, hiking routes and F-roads (highland roads).
1.6 "Membership" means the paid services offered in the App: the Quarterly auto-renewable subscription (which may include a free trial) and the Lifetime one-time purchase (including any trial-exclusive upgrade offer).
1.7 "Intellectual property" means copyrights, trademarks, patents, trade secrets, database rights, digital rights and all other intellectual property rights, whether registered or not.
2.1 Acceptance. By downloading, installing, registering for or using the App, you confirm that you have read, understood and agree to these Terms of Service. If you do not agree with any part, stop using the App and uninstall it.
2.2 Modification. The operator may amend these terms at any time. Amended terms will be announced in the App or by push notification. Continued use of the App constitutes acceptance of the amended terms. If you do not agree, stop using the App and delete your account.
2.3 Priority. If these terms conflict with any other rules, announcements or notes published by the operator, these terms prevail.
3.1.1 The operator holds complete and exclusive intellectual property rights in:
3.1.2 These works are protected by applicable copyright law and international copyright conventions. All rights not expressly granted to users are reserved by the operator.
3.1.3 Infringement. Any of the following, without the operator's written permission, constitutes infringement and may result in legal action, including cessation orders and damages (including reasonable enforcement costs):
3.2.1 Map base layers are provided by Apple Maps and subject to Apple Inc.'s license terms.
3.2.2 Some map data comes from OpenStreetMap, subject to the Open Database License (ODbL).
3.2.3 Road condition data originates from the Icelandic Road and Coastal Administration (Vegagerðin).
3.2.4 Weather data originates from the Icelandic Meteorological Office (Veðurstofa Íslands) and Open-Meteo.
3.2.5 Fuel price data originates from publicly posted station prices aggregated by Gasvaktin.
3.2.6 EV charger data comes from OpenChargeMap.org under the Creative Commons Attribution 4.0 International (CC BY 4.0) license.
3.2.7 The above third-party rights remain with their respective owners; the operator holds only lawful usage rights.
4.1 Lawful use. You may use the App only for lawful, personal, non-commercial purposes.

Free tier: free users can browse all free places, road condition overview, weather and currency tools; favorites are limited to 6 places (including supermarkets); the aurora forecast shows only a summary for the current night. After a membership expires, existing favorites remain visible but cannot be added to; resume adding by renewing or reducing below the limit.
5.2.1 Quarterly is an auto-renewable subscription. If your subscription includes a free trial, you will not be charged during the trial. Unless you cancel at least 24 hours before the end of the trial or the current billing period, your Apple ID account will be charged the subscription price at renewal. The subscription renews every 3 months until cancelled.
5.2.2 Cancellation: manage or cancel anytime in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period; no partial refunds for unused time except as provided by Apple's policies.
5.2.3 Renewal reminder: the App will attempt to send you a local reminder notification 24 hours before each renewal (requires notification permission), and your next renewal date is always visible in the App (Me tab → membership card). These reminders are a courtesy; managing your subscription remains your responsibility.
5.2.4 Lifetime is a one-time, non-consumable purchase. It does not renew and needs no cancellation.
5.2.5 Trial-exclusive upgrade: during an active free trial, the App may offer a discounted Lifetime purchase. It is a separate one-time purchase, immediately ends the subscription (no subscription charge will occur), and is final once completed.
5.3.1 All purchases are processed by Apple through the App Store, and refunds are governed by Apple's refund policy. You may request a refund from Apple within the period Apple allows.
5.3.2 The operator does not process refunds directly. Contact Apple Support for refund requests.
5.3.3 If Apple grants a refund or revokes a purchase, the operator may terminate the associated membership immediately, and associated data (such as favorites) may be retained only per the Privacy Policy.
The operator may adjust membership prices. For the Quarterly subscription, Apple will notify you of any price increase in advance and, where required, ask for your consent; the new price applies only to subsequent renewals. Price changes do not affect purchases already completed.
6.1.1 Road conditions, fuel prices, exchange rates, forecasts and place descriptions in the App are for reference only and do not constitute travel advice, safety guidance, professional instruction or commercial advice of any kind. You must judge the applicability of the information yourself and bear all risks of decisions made in reliance on it.
6.1.2 Iceland-specific risks: Iceland's high-latitude weather is extremely volatile and road conditions change rapidly. F-roads (highland roads) open only in specific summer windows and require suitable 4WD vehicles; rental insurance frequently excludes them. Sneaker waves at Reynisfjara and other beaches have caused fatalities. Before travelling, always verify road openings on road.is, weather warnings on vedur.is, and safety alerts on safetravel.is; check your rental car's insurance coverage; and share your itinerary with someone.
6.1.3 Despite our efforts to keep data current, information shown in the App may be delayed, inaccurate or incomplete due to network latency or third-party source failures. The operator accepts no liability for any direct or indirect loss arising from inaccurate data.
The App may be suspended for maintenance, upgrades or force majeure. The operator will try to give advance notice but does not guarantee 100% availability, and accepts no liability for losses caused by interruption, data loss or malfunction.
The App may contain links to third-party websites (e.g. vedur.is, road.is). These are provided for convenience only and do not imply endorsement. You visit third-party sites at your own risk.
6.4.1 To the maximum extent permitted by law, the operator is not liable for any personal injury, property damage, data loss, loss of profit, loss of goodwill or other indirect, incidental, special or punitive damages arising from use of or inability to use the App, whether foreseeable or not, and regardless of legal theory (contract, tort, strict liability or otherwise).
6.4.2 Where liability cannot be fully excluded by law, the operator's aggregate liability is capped at the total fees you have paid for the App.
6.5.1 You are responsible for your own travel decisions and safety. The App is not a substitute for professional guides, tour operators, medical services or local emergency services.
6.5.2 In an emergency in Iceland, call 112 immediately.
7.1 Account security: you are responsible for your own Apple ID and device security. The operator is not liable for losses caused by your disclosure of credentials or by third-party attacks.
7.2 Account deletion: you may delete your account yourself in the App (Me tab → Delete Account), effective immediately. Your account and all associated server-side data are permanently deleted and cannot be recovered. Purchase records are retained only in anonymized form for financial audit purposes, as described in the Privacy Policy.
7.3 Operator's termination right: if you breach these terms, the operator may terminate your account at any time without refund.
7.4 Service termination: the operator may discontinue the App with 30 days' advance notice via in-app announcement. Membership fees are not refunded upon service termination, but you may export your personal data before termination.
8.1 The operator may send you notices via in-app announcements, push notifications, or the email address associated with your account.
8.2 Notices to the operator should be sent to ingolfur.chen@gmail.com and are deemed delivered upon successful sending.
9.1 These terms are governed by the laws of Iceland, excluding conflict-of-law rules.
9.2 Disputes shall first be resolved through friendly consultation; failing that, either party may bring the matter before the competent courts of Iceland.
9.3 If you are a consumer in the EEA/UK, nothing in these terms deprives you of the mandatory consumer protections of your country of residence.
9.4 If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force.
10.1 Entire agreement: these terms constitute the entire agreement between you and the operator regarding the App and supersede all prior oral or written understandings.
10.2 No waiver: the operator's failure or delay in exercising any right does not constitute a waiver.
10.3 Severability: each provision is independent; invalidity of one does not affect the others.
